GENERAL TERMS AND CONDITIONS FOR THE SALE OF PRODUCTS OR SERVICES

NOTICE: Sale of any Products or Services is expressly conditioned on Buyer’s assent to these Terms and Conditions. Any acceptance of Seller’s offer is expressly limited to acceptance of these Terms and Conditions and Seller expressly objects to any additional or different terms proposed by Buyer. No Buyer form shall modify these Terms and Conditions, nor shall any course of performance, course of dealing, or usage of trade operate as a modification or waiver of these Terms and Conditions. Any order to purchase products or receive services shall constitute Buyer’s assent to these Terms and Conditions.

WARRANTY

Goods sold are non-refundable.

Replacement parts are provided only once during the warranty period.

1 month: voltage lock, display, front & tail light, on-off switch, controller.

3 months: brake discs, brake levers, charger.

6 months: handlebar, folding mechanism, springs/shocks, rear-wheel fork, folding buckle, battery, motor (motor wire issues not included). The warranty does not cover conditions, malfunctions, or damage caused by incorrect usage, maintenance, or adjustment as advised in the user manual.

We provide our customers with free replacements parts once, shipment of parts shall be shouldered by the purchaser and replaced part shall be returned to Seller headquarters. The warranty is limited to the first purchaser only and if you sell your Electric Scooter it cannot be transferred to the next purchaser. If you need to claim under the warranty the purchaser is required to present the purchase invoice.

Warranty shall only be claimed at Seller main store or any partnered service center.

You will either be instructed to solve/address this problem on your own through our assistance/parts delivery for your convenience. Otherwise, for more serious problems that cannot be remotely diagnosed and addressed, you will be asked to bring it to our partnered service center.

The brake pads, tubes, tires, consumable parts and regular wear and tear of all parts are all excluded from the warranty terms. Any damages, malfunctions performance issues caused by collision, fire, any forms of accidents, environmental conditions, overloading, lack of routine care and maintenance, and/or other misuse not in line with the product's intended purpose.

The warranty will be void in the following conditions:

  • Conditions, malfunctions or damage caused by incorrect usage, maintenance or adjustment as advised in the user manual;
  • Conditions, malfunctions or damage caused by or during the time that a user is under the influence of drugs, alcohol or any other mind-altering influences;
  • Conditions, malfunctions or damage caused by acts of nature;
  • Conditions, malfunctions, or damage caused by or as a result of the customer self-modifying, decomposing, or destroying the parts without prior authority from the manufacturer.
  • Conditions, malfunctions, or damage caused by the use of non-original parts or unauthorized circuit and configuration change.
  • Conditions, malfunctions, or damage caused by overloading, lack of routine care and maintenance, and/or other misuse not in line with the product's intended purpose.
  • Fractures/raptures or loss of plastic parts inclusive of the choke, charging port, handlebar switches, and plastic flaps.
  • Any utilization intended for commercial needs, rental, competitions and freights towing.
  • The utilization of components that were not supplied by the manufacturer (non-genuine parts).
  • Brake pads, tubes, tires, consumable parts and regular wear and tear.

 

SELLER MAKES NO OTHER WARRANTY WITH RESPECT TO THE PRODUCTS, AND DISCLAIMS ANY AND ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

Seller personnel are not authorized to alter this disclaimer of warranty.

MAINTENANCE

Cleaning: Since water and electricity don’t mix, you can’t clean your scooter like you would your car. Instead of hosing it down, use a damp rag and water to carefully wipe dust and dirt from the bike. If you’ve got stubborn areas of grime or stuck-on insects, use an all-purpose cleaner to wipe it away. Overall, the goal is to get the scooter clean without using excess water, taking care to keep moisture away from sensitive electronics and batteries.

Battery: Batteries are usually the most expensive part of a scooter. If the temperatures are below freezing and it is raining, it is strongly recommended NOT to ride our electric scooter. Operating your electric scooter in the rain below freezing temperatures causes your battery and motor to overwork. This adversely affects the longevity of the battery and the electric motor.

Controllers overheat protection: the controllers and the battery has temperature sensors and the scooter stops working when it gets too hot. Please wait about 0.5-2 hours to cool down the scooter or use eco/1st gear to continue riding after 5-10 minutes.

Tires: Make sure to check the air pressure regularly. Keep them at the recommended air pressure, which is indicated on the sidewalls of the tires. Whether your scooter has pneumatic or solid tires, regularly look for wear and tear, and replace tires when treads get too low.

Motor: Motor wires should be checked regularly.

Brakes: If you find rust or excessive wear on the brakes, which will occur with regular use over time, the brake pads should be replaced.

Preventive Maintenance Services: Preventative maintenance is an essential step in helping to keep your vehicle performing as it should for as long as possible. “Preventative” maintenance refers to the regular and routine servicing of your vehicle’s parts and components that will help prevent unplanned equipment failures in the future. The Client is entitles to one (1) FREE PMS within first 6 months after purchase.

TERMS OF USE

The Customer expressly acknowledges, understands, and agrees that the purchase of an electric scooter from the Company involves inherent risk, including the risk of serious injury and/or death and/or property damage, and that many factors cause unpredictable conditions and circumstances.

The Customer attests that he or she does not have any physical condition or limitation that would prevent him or her from operating an electric scooter. It is the responsibility of the Customer to carry full and complete insurance coverage on his or her personal property, and him or herself.

The Customer agrees to assume full responsibility for any and risk involved in or arising from the Customer’s use of an electric scooter from the Company, including, without limitation but not limited to, the risk of death, bodily injury, personal injury, property damage, falls, collisions, fire or explosion, or the negligence of the Company or any agents, servants, or employees thereof or of another person, or any other harm, damage, or injury.

The Customer agrees to hold the Company and all of its and their successors, assigns, subsidiaries, franchises, affiliates, officers, directors, employees, and agents completely harmless and not liable and hereby release, waive, and discharge them from all liability whatsoever and agrees not to sue them on account of or in connection with any claims, causes of action, injuries, damages, cost or expenses arising out of the Customer’s use of Company products.

The Customer agrees to waive the protection afforded by any statute of law in any jurisdiction whose purpose, substance and/or effect is to provide that a general release shall not extend to claims, material or otherwise, which the release does not know or suspect to exist at the time of executing the release.

Paper or Electronic Acceptance. This Agreement may be accepted and entered into either by paper signature of the Client or by electronic acceptance of the terms of this Agreement, which acceptance shall constitute an electronic record of the Agreement between the parties. The undersigned has read and voluntarily signs / electronically accepts this Terms of Use and Release Agreement, and further agrees that no oral representations, statements, or inducements apart from the foregoing written agreement have been made.

LIMITATION OF LIABILITY

IN NO EVENT SHALL SELLER BE LIABLE TO BUYER OR ANY THIRD PARTY FOR ANY LOSS OF USE, REVENUE OR PROFIT OR DIMINUTION IN VALUE, OR FOR ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES WHETHER ARISING OUT OF BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE AND WHETHER OR NOT SELLER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND NOTWITHSTANDING THE FAILURE OF ANY AGREED OR OTHER REMEDY OF ITS ESSENTIAL PURPOSE.

IN NO EVENT SHALL SELLER’S AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THIS CONTRACT, WHETHER ARISING OUT OF OR RELATED TO BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, EXCEED THE TOTAL OF THE AMOUNTS PAID TO SELLER FOR THE PRODUCTS SOLD HEREUNDER OR, AS TO SERVICES, FOR THE AMOUNTS PAID TO SELLER FOR SERVICES PERFORMED HEREUNDER.

This limitation of liability is a material basis for the parties’ bargain and reflects the bargained-for allocation of risks between Seller and Buyer, without which Seller would not have agreed to provide the Products or services at the price charged.

COMPLETE AGREEMENT

These General Terms and Conditions constitute the entire agreement between Buyer and Seller relating to the subject matter hereof, and supersede all prior and contemporaneous discussions, understandings, and agreements related to the subject matter hereof.

ANY PURCHASE OR USE OF OUR PRODUCTS AND SERVICES IMPLIES THAT YOU HAVE READ AND ACCEPTED OUR TERMS AND CONDITIONS.
